Idaho Court of Appeals

The Idaho Court of Appeals is the state’s intermediate appellate court. It was established in 1980 to support the Idaho Supreme Court by reviewing cases assigned to it. The court helps ensure that appeals are resolved efficiently while upholding Idaho’s commitment to fair and timely justice.

About the Court

The Court of Appeals was created to manage a growing number of appellate cases and reduce delays in the judicial system. Its role supports the constitutional goal of providing “right and justice without delay.”
The court reviews decisions from Idaho’s trial courts to determine whether the law was applied correctly. It does not conduct new trials. Instead, it examines the record from the original case to identify potential legal errors.
  • Reviews the legal reasoning in trial-court decisions
  • Does not hear new evidence or call witnesses
  • Ensures that Idaho law is applied fairly and consistently
  • Issues written decisions that may affirm, reverse, or modify a lower court’s ruling
Cases assigned to the Court of Appeals are decided by a three-judge panel. Each panel reviews the trial-court record, considers written briefs, and may hear oral arguments. After review, the judges issue a written opinion.
Parties who disagree with a Court of Appeals decision may petition the Idaho Supreme Court for review. The Supreme Court may choose whether to accept the case.
The Idaho Supreme Court assigns cases to the Court of Appeals. Most case types can be referred, except for: capital punishment cases, extraordinary writs, appeals from the Industrial Commission, and appeals from the Public Utilities Commission.

The Court of Appeals is located in Boise in the Idaho Supreme Court building. Judges may travel to hear cases across Idaho as needed to improve public access and convenience.
