Water Adjudication

Water adjudication is the legal process used to determine who has the right to use water in Idaho and how much they may use. Because water is one of Idaho’s most important resources, the Idaho Judicial Branch plays a key role in confirming these rights and ensuring they are recognized and enforceable.

Purpose of Water Adjudication

The purpose of water adjudication is to create a complete and accurate record of all water rights within a specific area. This record helps Idaho manage water fairly, resolve disputes, and support long-term planning for agriculture, communities, and industry.

Water adjudication does not change water rights. It verifies them.

The Court’s Role

The Idaho Judicial Branch oversees the legal steps that confirm water rights. This includes:

  • Reviewing recommendations prepared by the Idaho Department of Water Resources
  • Hearing objections or disputes from water users
  • Issuing final decrees that establish legally recognized water rights
  • Ensuring decisions comply with Idaho law and existing water-management systems

These legal decisions become the foundation for water administration across the state.

How the Process Works

Water adjudication involves multiple stages:

  • 01

    Reporting

    The Idaho Department of Water Resources collects information from water users and prepares a recommended water-rights report.
  • 02

    Review by Water Users

    Individuals, businesses, irrigation districts, and other water users may examine the recommendation and file objections if they disagree with any part of it.
  • 03

    Judicial Review

    The Idaho district court assigned to the adjudication reviews objections, conducts hearings when necessary, and issues orders resolving each contested issue.
  • 04

    Final Decree

    Once the court addresses all objections and confirms the record, it issues a final decree. This decree is the official list of water rights for that basin or region.

  • Reduce conflict among water users

  • Support agriculture, industry, municipalities, and recreation

  • Protect senior water rights

  • Plan for growth and future resource needs

  • Final decrees also strengthen Idaho’s ability to administer water consistent with state law

Idaho’s Adjudications

Idaho has conducted several large water adjudications, including the Snake River Basin Adjudication and the ongoing Coeur d’Alene–Spokane River Basin Adjudication. Each adjudication supports long-term management of regional water supplies.
