Committees discuss and vote to recommend a new rule or rule amendment.
Committee minutes and any proposed rules or amendments are posted on the Supreme Court website and notice that comments are being sought is placed in the E-News as well as the e-bulletin sent out by the Idaho State Bar. Here is where rules are posted for comment.
If it is believed a particular section of the Bar or a particular group of attorneys will have special interest in the rule, then those groups are contacted as well. Any comments received are forwarded to the Chair of the Committee in case the Chair believes further action needs to be taken before the proposed amendment is forwarded to the court.
The proposed amendments are also placed on the agenda for the Administrative Conference. The full text of the proposal is always included, along with relevant committee minutes or other explanation. If the Administrative Conference recommends a further revision, then the Court is advised of this when considering the proposal. If the Administrative Conference is opposed or has substantial reservations or revisions, then the Chair of the committee is advised and further action is taken as needed.
When the Court considers adopting a rule or rule amendment, the Court is provided the comments received, as well as the recommendation of the Administrative Conference.
